Industrial Court orders firm to pay 1.3 Million over wrongful sack

The National Industrial Court sitting in Lagos on 18th January, 2018 has awarded the sum of =N=150,000.00 per month from June 2014 to 25/3/15 against 1004 Estates Limited & Anor, in favour of  Mr. Tunde Ayoola-Johnson, for his wrongful employment termination by the company.

Mr. Tunde Ayoola-Johnson claimant through his counsel J. Akolade Esq. filed the suit on 25th of March, 2015 sought among others declaration of this Honourable Court that the indefinite suspension of the Claimant from the services of the Defendants without recourse to the terms of his employment and without any indictment for wrongdoing is unlawful and amounts to a wrongful termination of his contract of employment.

The Court presided by Hon. Justice Dele Peters after reviewing the argument of parties, said “ I have carefully read through the facts of this case, the written arguments of counsel to the parties including their cited authorities.

Finally, for the avoidance of doubt and for all the reasons as contained in this Judgment,

I find and hold that the indefinite suspension of the Claimant by the 1st Defendant amounts to wrongful termination of the employment of the Claimant effective from 25/3/15 being the date of filing of this case.  As a consequential order, I order the Defendants to pay to the Claimant his salaries and allowances in the sum of =N=150,000.00 per month from June 2014 to 25/3/15 being the date of filing this suit.

 All the terms of this Judgment shall be complied with within 30 days from today.-Says Justice Dele Peters
