[Extra] Industrial Court orders firm to pay Ex-Staff Bunmi Iyoha N1 Million within 14 days

His Lordship, Hon. Justice Isaac Essien of the National Industrial Court Lagos Judicial Division has ordered Wealth Island to pay its former staff Miss Bunmi Iyoha the sum of N750, 000 owed salary from May to July 2015, N200,000 general  damages and 50,000 cost of action within 14 days. 

 

The claimant - Bunmi alleged that 13 months after her appointment, the firm advised her to resign and do a handing over note before her entitlement would be paid which she complied with, and further that her resignation was in breach of the terms of her appointment, that his leave allowance of N180, 000 and her salary for May, June and July remain unpaid. 

 

However, despite the service of hearing notices, the defendant was absent and unrepresented in court to cross-examine the claimant witness and to put in their defence. 

 

Delivering Judgment after careful analysis of the submission of the counsel, the trial Judge, Justice Essien held that no provision in the terms of the offer of employment to establish the claimant entitlement to leave allowance, dismissed the claim for lack of proof.

 

“This court is of the strong view that refusal to pay the claimant her three months salary when she resigned her position as at July 2015 has caused her some inconveniences and denied her the use of her earned salary. For this reason, the claimant is entitled to damages.” Justice Essien Ruled.
