Ibadan---His Lordship, Hon. Justice Faustina Kola-Olalere of the National Industrial Court sitting in Ibadan has set aside directive of the Oyo State Government on compulsory retirement of Mr Wasiu Adeniyi from Broadcasting Corporation of Oyo State.
The court held that the purported directive is contrary to the provisions of the Civil Service Regulations and the Public Service Rules of Oyo State.
Mr wasiu joined the services of the BCOS and was deployed to the office of the Governor of Oyo State as Assistant Director and was redeployed back after spending 4 years.
He continued that subsequently, he was compulsorily retired from the public service of Oyo State through a letter signed by the corporation CEO contrary to the provisions of the State Civil Service Commission Regulation.
Defendant maintained the Management had introduced new innovations into the Broadcasting Industry and was fully convinced that Mr Wasiu who left the services of the corporation for over 4 years would no longer be relevant, hence the claimant was not re-absorbed and was compulsorily retired and the Director was advised to compute the claimant's final entitlements.
In opposition, counsel to the claimant Ayo Faleti Esq argued that the preparation of any final entitlement of the claimant will not absolve or avail the corporation of its wrongful act.
Delivering the Judgment, the trial Judge, Justice Kola-Olalere held that no provision under the Civil and Public Service Commission Regulations of Oyo State allows the Chief Executive Officer of the Corporation to compulsorily retire a level 14 Public Officer from Oyo State Public Service without following due process and without recourse to the State Civil Service Commission.
In all, the Court declared the compulsory retirement of the claimant by the defendants as illegal, null and void and of no effect.
