Abuja --His Lordship, Hon. Justice Sanusi Kado of the National Industrial Court of Nigeria, Abuja Judicial Division on Tuesday 18th December 2018 granted an interim injunction, restrained Parliamentary Staff Association of Nigeria (PASAN), Chairman and secretary of PASAN, clerk of the National Assembly from taking any step or directing their members to embark on any act(s) that may culminate in the shut-down of the National Assembly Complex pending the hearing and determination of the motion on notice pending before the court.
The Senate President, Federal Republic of Nigeria, The Speaker of the House of Representative and the National Assembly, Federal Republic of Nigeria approached the court seeking against Parliamentary Staff Association of Nigeria (PASAN), Clerk of the National Assembly and 4 others among others; AN ORDER of Interim Injunction restraining all the defendants/Respondent, particularly their agents, assigns, privies, servants, however so called from taking steps to proceed or proceeding on strike, pending the determination of the Motion on notice in this case.
Likewise, AN ORDER of Interim Injunction restraining all the defendants/Respondent, particularly their agents, assigns, privies, servants, however so called from taking any steps whatsoever in respect of the subject matter in this litigation, pending the determination of the Motion on notice in this case.
The Claimant’s Counsel A. P. Ameh Esq filed the application and Affidavit of support of the Motion Exparte for Interim Injunction.
After carefully appraising the facts and circumstance that led to the institution of this action, His Lordship, Hon. Justice Sanusi Kado expressed thus;
“An order of interim injunction is thereby made against the defendants/respondents, their agents, privies, assigns, servants however called restraining them from taking any step in respect of subject matter of this suit or directing members of the 3rd defendants/respondents to embark on any act(s) that may culminate in the shut-down of the National Assembly Complex.
“An order of interim injunction is thereby made restraining the defendants/respondents, their agents, privies, assigns, servants however called from blocking access to the gate leading to the National Assembly Complex or preventing any member of staff of National Assembly Complex who desire to perform his or her lawful duties from ingress to the National Assembly Complex pending the hearing and determination of the motion on notice pending before the court.
“The management and leadership of the National Assembly are hereby ordered not to do anything that may hinder any ongoing dialogue to settle the dispute with the defendants/respondents, pending the hearing and determination of the motion on notice now pending before the court.
“The order should in addition to being served on the defendants/respondents, be posted on the gate and entrances of the National Assembly Complex.” Justice Kado Ruled.
