The Presiding Judge, Kano Judicial Division of the National Industrial Court, Hon. Justice E. D. Isele has ordered the Film Laboratory And Production Serviced Limited to pay Ahmed Bello the sum of N2,115,268:52 (Two Million One Hundred and Fifteen Thousand Two Hundred and Sixty-Eight Naira and Fifty-Two Kobo) only being his retirement benefits and Pension entitlement within 30 days.
Justice Isele held that Ahmed Bello has satisfied the legal requirement for the grant of summary application as the Film Laboratory proferred no defence to the action.
From facts, the claimant- Ahmed Bello had submitted that Film Laboratory and Production Ltd employed him in 2003 as a staff as a casual staff and was confirmed as a permanent and pensionable staff effective from December 2004.
He also averred that after serving the firm for the period of 15 years, he voluntarily resigned from the service in 2019 and during his service with the Defendant, all staff were requested to register with a Pension Fund of their choice as directed by the National Pension Commission pursuant to which a circular was issued.
He submitted that all efforts to get his retirement entitlement and pension deduction were to no avail.
However, the defendant- Film Laboratory and Production failed to file any defense to the matter despite being served with hearing notices.
Mr. Ahmed urged the court to grant his application on summary judgment on the grounds that his claim before the court is a liquidated demand, and the firm has admitted his claim in one of their correspondence to him, and furthered that the company has no defence to the action.
Delivering the judgment after careful evaluation of the submission of the counsel, the presiding Judge, Justice Isele held that the Claimant has satisfied the legal requirement for the grant of summary application as the Defendant has proferred no defence to the action.
