Industrial Court strikes out NANS’ suit against ASUU, FG

The Abuja vacation judge of the National Industrial Court, Hon. Justice Polycarp Hamman on Tuesday, struck out a suit filed by the National Association of Nigerian Students, NANS to compel the Academic Staff Union of Universities, ASUU, and the Federal Government to call off the ongoing strike action.


Justice Polycarp Hamman terminated further proceedings in the matter after it was withdrawn by the claimant, Umar Lawal.


From facts, Umar Lawal had filed the suit for himself and on behalf of NANS against the Academic Staff Union, the Minister of Education, and the Attorney-General of the Federation.


Furthermore, when the matter came up on Tuesday, Lawal, notified the court that he filed a motion for discontinuance and he premised his decision to withdraw the suit on account of the challenge by the student body which contested his standing as the President of NANS as he had deposed to.


Though the Minister of Education and the Attorney-General of the Federation were not represented, however, counsel to ASUU, Marshal Abubakar Esq. informed the court that he was not opposed to Lawal’s application to withdraw the suit.


Delivering the ruling after careful evaluation of the submission of both parties, the presiding Judge, Justice Polycarp Hamman struck out the matter.
