Industrial Court orders Geidam Local Government Council, Yobe AG to pay Ahmed Tijjani and 49 others Gratuity, Pension

The Presiding Judge, Kano Judicial division of the National Industrial Court, Hon. Justice E. D. Isele has ordered the Geidam Local Government Council, Commissioner for Ministry For Local Government And Chieftaincy Affairs, Yobe State Local Government Service Commission, and its Attorney General and Commissioner for Justice to comply with the agreed terms of settlement on the suit filed by Ahmed Tijjani and 49 others as final and full settlement.


The Court entered the judgment in accordance with the terms of settlement consented by both parties in substantial compliance with the rules of the court.


From facts, the claimant- Ahmed Tijjani and 49 others had sought amongst others for an ORDER of the Court directing or mandating the Defendants, particularly Geidam Local Government Council to concomitantly pay them all their salaries, emoluments, and other office prerequisites from December 2011 to date with immediate effect.


However, on the 10th day of May 2022, the matter came up for adoption of the terms of settlement where Parties and their counsel have met and agreed that the terms of settlement be adopted as consent Judgment of the Honourable Court.


Delivering the judgment, Justice Isele ruled on the terms of settlement as agreed by both parties and awarded no cost of action in the spirit of an amicable settlement.


By virtue of the terms of the settlement, it was stated that the defendants have agreed to retire or disengage Ahmed Tijjani and 49 others from the service of Geidam Local Government Council effect from December 2011 and the computation of their entitlement shall be in accordance with the current Local Government Minimum Wages of Yobe State.


Furthermore, it was also agreed that the Claimant (s) who have put in Five (5) years but less than Ten Years (10) in the service of Geidam Local Government Council shall be entitled to gratuity only and nothing more at all; and those that have out in Ten (10) years and above in the service of the 1st Defendant and have attained the age of Forty-Five (45) years shall be entitled to gratuity and pension arrears.


While those that have out in Ten (10) years in the service of Geidam Local Government Council but have not attained the age of Forty-Five (45) years shall be entitled to gratuity and shall also be entitled to Pension on the attainment of Forty-Five (45) years of age unconditionally.


It was further agreed that both the gratuity and Pension arrears shall be paid in bulk to the Claimants who have become due within the period of stagnation unconditionally.
