Industrial court refuses to grant restraining order against firm, 2 others from sailing vessel

The Presiding Judge, Calabar Judicial division of the National Industrial Court, His Lordship, Hon. Justice Sanusi Kado has refused to grant an order for an interlocutory injunction aimed to restrain MT Aysu a vessel lying at Calabar Port on the absence of facts disclosing urgency for granting such order.


The court directed that all processes commencing the suit, as well as the motion for interlocutory injunction, be served on Pebeto Enerji Limited, Nigerian Maritime Administrative and Safety Agency, and Nigerian Port Authority who are parties in the suit; and ordered all the parties not to engage in any act or do anything that will jeopardize the hearing of the motion on notice.

 

Learned Counsel Nelson Otaji Esq had filed the motion on behalf of the applicant, Idoho Micheal, and 23 others against Pebeto Enerji Limited and 3 others.

 

Justice Kado adjourned the case to the 28th day of September 2021.
